BYLAWS OF THE EAST KAUAI WATER USERS' COOPERATIVE

ARTICLE 18. WATER USAGE/ALLOCATION.


18.01 Responsibilities. The storing and distribution of water in the system shall always be subject to the discretion of the Board of Directors, and all rights of members to the use of water shall be at all times subject to such rules and regulations as may, from time to time, be prescribed by the Board of Directors. The Board of Directors shall require a Water Use Agreement for all members purchasing or using water.

18.02 Water Commitment. Members do not have to commit to the purchase of water from the association. However, members who sign a Water Use Agreement will get priority use of irrigation water. In times of shortage, members who do not sign the Water Use Agreement may not get an allocation of water.

18.03 Member Commitment Voting. Each member who signs a Water Use Agreement with the association is eligible for additional votes, not to exceed forty percent (40%) of the total. Members shall receive one vote for each one million gallons per year allocation unit committed to the Corporation. The Secretary shall keep an accurate record of the number of votes each member is entitled to.
